All The Loft Collection (TLC) members agree to the following terms and conditions when using our space. Please ensure that you familiarise yourself with the ‘house rules’.

The Loft Collection was created to promote a collaborative, community driven, shared office space in support of local entrepreneurs, businesses, project teams, freelancers, and other individuals in the South Peninsula of Cape Town. By joining TLC, our members agree to certain rules that allow for productivity in our community hub. By joining, you pledge to be considerate of fellow community members at all times.

You will get out of your membership what you put in, so be a part of the TLC community by getting to know your fellow co-workers. Any questions relating to this agreement should be sent to us via our contact us page.

CONDUCT Be on your best behaviour in order to help us maintain a great place to work for all members.

If another TLC Member or TLC Management notices disruptive or abusive language or any other behaviours that are inconsiderate to others in our work environment, a warning will be issued. On the third warning, membership will be revoked. Membership may be revoked prior to the third warning upon the sole discretion of TLC CoWorking Management.

These are the general rules we ask you to abide by:

NOISE LEVELS We are all trying to get work done, so try to be mindful and respectful of your vocal levels. No shouting is allowed. Generally, if someone has their headphones on, please respect their privacy.

HARASSMENT & DISCRIMINATION Harassment of TLC members and/or guests will not be tolerated and will be dealt with swiftly. Members and/or guests who violate this policy may be asked to leave the premises immediately and may have their memberships revoked with immediate effect; this is at the sole discretion of TLC Management. We want to make sure that everyone has a harassment-free experience, regardless of gender, race, ethnicity, religion, disability, sexual orientation, gender identity, or physical appearance. Harassment includes: showing offensive sexual photography or recordings; unwelcome sexual attention; unwelcome sexual contact; sexual comments; stalking; deliberate intimidation; following into bathroom spaces. People asked to stop any harassing behaviour are expected to comply immediately.

GUESTS We are a community, so please invite friends or guests for lunch, a quick meeting, or just to say hi. It is okay for your guests to have a cup of coffee every now and then, but please be reasonable with this. Guests are required to adhere to the house rules.

KITCHEN APPLIANCES & USAGE The fridge is primarily for storing food, beverages, and some occasional leftovers from events. As a general policy, food that is older than one week will either be thrown out or donated to a local charity, if safe for consumption. Labelling your food items is advisable. All crockery, cutlery, kitchen utensils and appliances are the property of TLC; these items may not be stored or moved out of the TLC coworking space. As we do not have a dishwasher, please ensure that all crockery and cutlery used is washed thoroughly and put back where found.

ALCOHOL POLICY Alcohol is permitted by prior arrangement with TLC Management only. This is a working space, and unless for an event or business lunch, consumption of alcohol is not allowed.

HOURS OF OPERATION. Although we offer extended working hours, TLC is not a 24/7 facility. This means that all members need to abide by the standard operating hours. No sleeping bags for overnight resting is allowed. Standard business hours are 07:30 – 21:00 Monday to Friday and 08:30 – 13:00 on Saturdays. We are closed on Sundays. Extended hours for events and conferences may be requested via our contact us page.

BOARDROOM The boardroom is bookable on the TLC website, and needs to be booked ahead of time. Catering can be provided by TLC Management if required, but please request this at least 24 hours in advance. The key to the boardroom is held by the TLC Community Manager. The boardroom will remain locked when not booked.

SAFETY Please read the Disclaimer of Liability signs in and around the building. Under no circumstances should members and their guests conduct any activity which may be harmful to other people in the building, including, but not limited to, littering around our space and creating excessive disorder on or around the space.

DELIVERIES TLC Management offer acceptance of deliveries free of charge. All parcels will be stored securely in the TLC Management offices.

MEMBERSHIP FEES All fees are payable in advance via the online booking system on the TLC website. All members agree to pay for membership upfront. Monthly memberships permit members to unlimited time usage for a calendar month, within the standard business hours and days.

MEMBERSHIP DAYS Unless you purchased an unlimited monthly membership, your membership allows you to work for the day(s) booked only. Bookings are monitored by TLC Management, so please stick to the rules of your chosen membership type.

EARLY TERMINATION If you want to terminate your membership agreement before the end of the Term, we will not refund any of the membership fees that you paid upfront. Specifically, this means that we will not do pro-rata refunds. And if you have any days, weeks or months remaining in your Term, you are agreeing to pay for those remaining months as well.

TERMINATION OF THIS AGREEMENT Although we would love for our members to stay with us, we reserve the right to terminate your membership at TLC at any time without notice. The conduct section outlines the primary actions that could lead to membership termination. Beyond those listed in the conduct section, you agree to not use TLC or the Solaris Business Park for any illegal or dangerous purposes. This includes any purpose that could disable or impair any of the TLC Property, keep other members from using TLC, or that would damage TLC as a service provider. This includes the use of our Internet, any network, computer system, or information the member does not have access to. Grounds for termination also apply to areas outside of TLC, including DS Fitness & Lifestyle Studio, common areas, and the Solaris Business Park property as a whole. Any misuse or misconduct in these areas may result in membership termination. If we terminate this agreement because of your conduct, we will not refund any fees paid upfront.

OBEYING THE LAW You also agree not to use TLC, DS Fitness & Lifestyle Studio, or Solaris Business Park property in connection with:

  • Contests, pyramid schemes, chain letters, junk email, spamming, etc.;
  • Defaming, abusing, harassing, threatening or otherwise violating the legal rights (such as privacy and publicity) of others;
  • Posting and distributing of inappropriate, profane, defamatory, obscene, indecent, or unlawful material or information;
  • Uploading, reproducing, using, performing or otherwise making available, images, software or other material or information which infringes on another’s rights, or is protected by intellectual property laws where you do not own or license such rights;
  • Uploading or using files that contain viruses, corrupted files, or any other similar software or programs that may damage the TLC Property or the computers or property of a member of TLC.

CONFIDENTIAL INFORMATION You acknowledge that during your membership at TLC, you are going to be exposed to things like business information, trade secrets, technology, messages, customers and prospects, and other confidential information a company or individual would not normally share but is disclosed by members due to proximity or observation. Members agree not to share under any circumstances the exclusive and confidential information gathered intentionally or unintentionally.

DISCLAIMER OF LIABILITY All persons entering these premises, or using any amenities or facilities on these premises, do so entirely at their own risk and subject to the following conditions:

These premises are private property and the owners, staff and management of these premises reserve the right to refuse admission or entry to any person. These premises are monitored 24/7 by closed-circuit television (CCTV) cameras linked to a control room..

The owners, staff and management of these premises, amenities and facilities do not accept any liability whatsoever for any injury or death of any person or the loss, destruction and/or damage to any property, whether arising from fire, theft or any other cause whatsoever and by whomsoever caused or arising from the negligence or gross negligence or wrongful acts of the owners, staff and management.

CHANGES TO THIS AGREEMENT From time to time, we will need to update this Agreement, which you will be required to agree to. For big changes, we will do our best to give you notice ahead of time that changes are coming.
